TERMS OF USE

Welcome to VIEUTOPIA (A brand managed by Vieunite, Company number 13883746) (“us”, “our”, “we” or “Vieutopia”). Vieutopia specialises in deep AI image generation services (The “Services”) These Terms of Service (the “Agreement”) spell out what rights you have with respect to the Service generated images, and other assets, which you generate (the “Assets”), your use of the Services.

These Terms are a binding contract between you and us. By accepting these Terms through Using VIEUTOPIA, you are accepting and agreeing to these Terms on behalf of yourself or the entity that you represent in connection with the Use of VIEUTOPIA. If you are Using VIEUTOPIA on behalf of another person or entity, you represent that you are authorized to accept these Terms on that person’ or entity’s behalf and that such person or entity agrees to be responsible to us if you or the other person or entity violates these Terms.

This Agreement is effective when the Customer is presented with this Agreement and proceeds to use the Services (the "Effective Date") or to receive or distribute Assets. These terms may be updated and presented again to the Customer from time to time. Continued use of the Services constitutes acceptance of the updated terms. If you do not agree to the Agreement, please stop using the Services.

Other documents referenced here may also bind Customer’s use of this Services, including the Community Guidelines below.

Where this Agreement refers to “you” or “your” it means the individual accepting this agreement; where it refers to “us”, “our” or “we” it means Vieutopia

1. DESCRIPTION OF VIEUTOPIA

VIEUTOPIA is an application-based software that uses artificial intelligence algorithms to transform your text prompts and / or photos into works of art. The artificial intelligence algorithms use styles inspired by various famous artists. Once you choose a filter or effect, VIEUTOPIA algorithm runs, generating an image. You can then share the images generated through social media sites or store them for personal use.

2. ELIGIBILITY

General age limitation. You must be at least 12 years of age to use VIEUTOPIA. If you are under 18 years of age (or the age of legal majority where you live), you may only use VIEUTOPIA under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a User under the age of 18 (or the age of legal majority), you agree to be fully responsible for the user’s acts or omissions.

VIEUTOPIA tries to make its Services PG-13 and family friendly, but the Assets are generated by an artificial intelligence system based on user queries. This is new technology and it does not always work as expected. No guarantees are made as to the suitability of the Assets for the Customer.

3. YOUR INFORMATION

By using the Services, you may provide VIEUTOPIA with personal information like your email address, user name, billing information, favourites, image outputs, and text prompts that you enter, or sample images that you upload to the Service. Both parties agree to comply with all applicable data protection laws. To the extent the parties need to enter into additional terms regarding data privacy or data transfers the parties will work together in good faith to enter into such terms.

4. PRIVACY

Please refer to our Privacy Policy for information about how we collect, use and disclose information about you when you Use VIEUTOPIA, and the rights you have with respect to your personal information. Transfer and storage of information about you, whilst you Use VIEUTOPIA, is governed by our Privacy Policy. You acknowledge and agree that your Use of VIEUTOPIA is subject to our Privacy Policy.

5. USER CONTENT

VIEUTOPIA may allow you to upload, edit, create, store and share photos (“User Content) You retain all rights in and to your User Content, as between you and us.

You represent and warrant that: (i) you own the User Content stylized by you on or through provide VIEUTOPIA or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) you agree to pay for all royalties, fees, and any other monies owed by reason of the User Content you stylize on or through provide VIEUTOPIA; and (iii) you have the legal right and capacity to enter into these Terms in your jurisdiction; and (iv) you grant us consent to use your User Content, regardless of whether it includes an individual’s name, likeness or persona, sufficient to indicate the individual’s identity. You further acknowledge and agree that our use of your User Content will not result in any injury to you or to any person you authorised to act on your behalf.

You may not upload, edit, create, store or share any User Content that violates these Terms or to which you do not have all the rights necessary to grant us the Company License described above.

We will not be liable to you for any modification, suspension or discontinuation of Service provided by VIEUTOPIA or the loss of any User Content.

6. COPYRIGHT AND TAKEDOWN POLICY

VIEUTOPIA uses an artificial intelligence system trained on public datasets to produce its Assets. All generated images are issued under a CC0(Creative Commons) license. This means that al parties relinquish all copyright and similar rights that are held in generated work and that these rights are dedicated to the public domain. Such Assets may be unintentionally similar to copyright protected material or trademarks you hold. We respect rights holders internationally. If you believe your copyright or trademark is being infringed by the Service, please write to Support@Vieutopia.com and we will process your request.

If we become aware that any of our Users have repeatedly infringed copyrights, we will take reasonable steps to disable access to VIEUTOPIA for such Users.

7. PROHIBITED CONDUCT AND COMMUNITY GUIDELINES

You will not violate any applicable contract, intellectual property law, any other applicable law or other third-party rights (including the Company rights) or commit a tort, and you are solely responsible for your conduct while Using VIEUTOPIA. Do not create images or use text prompts that are inherently disrespectful, aggressive, or otherwise abusive. Violence or harassment of any kind will not be tolerated.

1. No adult content or gore. Please avoid making visually shocking or disturbing content. We will block some text inputs automatically.
2. Sharing others’ creations. Do not publicly repost the creations of others without their permission.
3. Do not attempt to circumvent blocked inputs through the use of synonyms or alternative spelling.

6. Any violations of these rules may lead to bans from our services. Please behave respectfully or lose your rights to use the Service.

We have the right to monitor your Use of VIEUTOPIA to ensure compliance with these Terms, and to comply with applicable law or other legal requirements. We have the right to investigate violations of Terms and /or our Community Guidelines. We may also consult and cooperate with law enforcement authorities to prosecute Users who violate the applicable law.

We reserve the right, in our discretion and at any time, to suspend or discontinue VIEUTOPIA a, introduce new features or impose limitations on certain features, or restrict access to VIEUTOPIA.

8. DISCLAIMERS

We do not control, endorse or take responsibility for any User Content (and its loss) or third-party content available on or linked to VIEUTOPIA. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

Your Use of VIEUTOPIA is at your sole risk. VIEUTOPIA is provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, we do not represent or warrant that VIEUTOPIA is accurate, complete, reliable, current or error-free. While we attempt to make your access to and Use of VIEUTOPIA safe, we cannot and do not represent or warrant that VIEUTOPIA or servers are free of viruses or other harmful components. You assume the entire risk as to the quality and performance of VIEUTOPIA.

9. FEEDBACK

We welcome your feedback, questions, comments, suggestions, ideas, original or creative materials or other information you submit about us or VIEUTOPIA (collectively, “Feedback”). You can submit Feedback by contacting us (please, see How to Contact us Section). Your Feedback is non-confidential and will become our sole property. We will own exclusive rights, including, without limitation, all intellectual property rights, in and to your Feedback and will be entitled to the unrestricted use and dissemination of your Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

10. CHANGES TO THESE TERMS

We may make changes to these Terms from time to time. If we make changes, we will post the amended Terms and update the “Effective date” above. You are expected to check our terms regularly so you are aware of any changes, as they are binding on you. We may also attempt to notify you by providing notice through VIEUTOPIA. Unless we say otherwise in our notice, the amended terms will be effective immediately and your continued Use of VIEUTOPIA after we provide notice will confirm your acceptance of those changes. If you do not agree to the amended terms, you must stop Using VIEUTOPIA.

11. TERMINATION

We reserve the right, without notice and in our sole discretion, to terminate your right to Use VIEUTOPIA We are not responsible for any loss or harm related to your inability to Use VIEUTOPIA. Upon any termination, discontinuation or cancellation of VIEUTOPIA, all provisions of these Terms, which by their nature should survive, will survive, including without limitation, ownership provisions, warranty disclaimers, limitations of liability and dispute resolution provisions.
